Nusinov Smith Law Firm Wins Tax Dispute Saving Tom Clancy’s Estate $8 Million

Norman Smith and Jeffrey Nusinov represent Mrs. Alexandra Clancy, Tom Clancy’s surviving spouse who contested the Will interpretation of attorneys at one of the largest law firms in Maryland. Nusinov Smith Law Firm Wins Case of First Impression in Maryland to Apply a New Test for a Blind Testator

In an attempt to undermine the express intentions of a testator, caveators challenged the validity of a Last Will and Testament based on application of Maryland’s long established precedent that the testator must be in the “line of sight” of the witnesses at the time they sign. Application in this case would have resulted in the Will being invalid. Despite no Maryland authority on the issue, Jeffrey E. Nusinov argued that Maryland should adopt the “conscious-presence test” for a blind testator.

The Court agreed with Nusinov: “Since a blind person is able to execute a will, it follows that whether the witnesses signed in the presence of the blind testator would require a test that is not based just on the ability of the testator to see the witnesses, but one in which the witnesses signed the will in the conscious presence of the testator.”

Nusinov’s in-depth understanding of the legal principles and willingness to take on the challenge of making new law resulted in the testator’s Will being admitted to probate.
